ProSurvey Apps Limited (registered in England and Wales with company number 17118570) ("we", "our", or "us") respects your privacy and is committed to protecting it through our compliance with this policy. This policy describes the types of information we may collect from you or that you may provide when you visit our website or use our mobile application ("DampApp Pro") and our practices for collecting, using, maintaining, protecting, and disclosing that information.

1. Information We Collect

We collect several types of information from and about users of our App, including:

  • Personal Information: Name, email address, phone number, and company details when you register for an account or generate reports.
  • Survey Data: Information, photos, and notes you input into the App while conducting surveys. This data is stored locally on your device and synchronized to our cloud servers if you subscribe to our Pro features.
  • Usage Details: When you access and use the App, we may automatically collect certain details of your access to and use of the App, including traffic data, location data, logs, and other communication data and the resources that you access and use on or through the App.

Microphone & Voice Dictation

DampApp Pro includes an optional voice dictation feature so you can speak survey observations instead of typing them. If you choose to use it, the App requests access to your device's microphone. Your speech is converted to text by your device's built-in speech recognition service (provided by Apple on iOS and Google on Android); to perform this conversion, your operating system may transmit the audio to Apple or Google for processing, subject to their respective privacy policies. We do not record, store, listen to, or transmit your audio to our own servers — only the resulting transcribed text is saved, as part of the survey content that you control. The feature is entirely optional: if you do not grant microphone permission, or simply do not use dictation, no audio is captured or processed.

2. How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal information:

  • To provide you with the App and its contents, and any other information, products, or services that you request from us.
  • To fulfill any other purpose for which you provide it (e.g., generating survey reports).
  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
  • To notify you about changes to our App or any products or services we offer or provide though it.

3. Surveyor Responsibilities as Data Controller

When using DampApp Pro to collect and process data relating to your clients, you act as the Data Controller under the General Data Protection Regulation (GDPR) and equivalent frameworks. You are solely responsible for ensuring you have the legal right and necessary permissions to collect, store, and process your clients' personal information through our App.

It is entirely your responsibility to manage data subject requests (such as requests for deletion, access, or export of client data) and to verify the accuracy of all data inputted into or generated by the application. We act strictly as a data processor in this context and accept no liability for regulatory data breaches originating from your use of the App.

4. Data Retention & Security

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on our secure servers behind firewalls.

While we strive to protect your data, no method of transmission over the Internet or electronic storage is completely secure. We cannot guarantee absolute security and accept no liability for accidental data loss arising from server outages, device failure, or internet disruptions. Users are responsible for regularly exporting and securing their own client data.

Cloud Data Retention Policy

To maintain server performance and minimize privacy risks, we automatically purge stale data from our cloud databases. By using DampApp Pro, you acknowledge and agree to the following automated deletion schedules:

  • Expired PRO Subscriptions: If your PRO subscription expires or is cancelled, you have a 30-day grace period to export your data or renew. After 30 days, all your cloud-synced surveys, images, and profile data will be permanently deleted.
  • Inactive Accounts: Any account (Free or PRO) that has not been logged into or actively opened for 365 consecutive days will be permanently deleted, including all associated cloud storage.
  • Storage Caps: To maintain system performance, Free accounts are strictly limited to retaining 25 surveys at any time. Active PRO accounts are permitted to store up to 5,000 cloud-synced surveys. Users nearing these limits must manually permanently delete or externally export obsolete surveys (e.g., via PDF or JSON) to free up storage space.
  • Data Portability & Export Modalities: To assist you with your GDPR obligations, DampApp Pro provides several data export options:
    • Individual Survey Exports: Exporting a single survey (e.g., to PDF) will include all associated media and images.
    • PRO Web Dashboard Exports: Exporting through the dedicated DampApp PRO web dashboard includes all high-resolution images and media attached to the surveys.
    • JSON Mass Import/Export: The in-app facility for mass exporting or importing raw .json database records strictly excludes all local images and media. This is designed to minimize unencrypted data payloads and protect client privacy during device transfers. However, if you are an active PRO subscriber utilizing our Cloud Sync feature, the exported JSON file will contain secure database links to your media already stored in our cloud infrastructure, allowing those images to be restored upon import. We accept no liability for data loss or mismanagement of files exported to external, unmanaged environments.

5. Third-Party Services

DampApp Pro may integrate with third-party application programming interfaces (APIs) and services such as RevenueCat (for subscription and identity management), Google Gemini, OpenWeatherMap, Open-Meteo, RainViewer, the GOV.UK Energy Performance of Buildings Data Registry, or user-defined SMTP servers. By using these features, you acknowledge that certain data (such as generalized property locations, postcodes, anonymized image data, or basic contact information tied to subscriptions) may be processed by these third parties in accordance with their respective privacy policies. We are not responsible for the privacy practices of any third-party services.

6. Cookies, Analytics & Advertising

Our website uses strictly necessary cookies to function. With your consent, we also load marketing and analytics cookies from third-party advertising and analytics partners — currently the Meta Pixel (Meta Platforms, Inc.) and the LinkedIn Insight Tag (LinkedIn Corporation), and we may add or change comparable partners in future. These help us understand how visitors find DampApp Pro and measure the performance of our advertising. No marketing or analytics cookies are set until you accept them via our cookie banner, and you can withdraw consent at any time by clearing the cookies in your browser. We use this data for our own analytics and advertising measurement only — we never sell your personal data. These partners process data in accordance with their own privacy policies, and where required we rely on privacy-preserving and consent-based mechanisms rather than cross-app device tracking.
